Your work is being copied. We stop it.
Under Dutch Auteursrecht (Copyright Law), you have the exclusive right to control your creations. Whether it’s stolen software code, unauthorized use of photography, or plagiarized content, Ember Law Firm enforces your rights, stops infringers, and claims damages.
Software & Code
Source code, SaaS platforms, databases, and digital interfaces are strictly protected against theft and unauthorized reproduction.
Photography & Video
Unauthorized use of commercial photography, artwork, or video content on websites or social media without a license.
Text & Courses
Plagiarism of written content, online masterclasses, e-books, and proprietary methodologies sold for profit.
Design & Branding
Protection of brand assets, logo designs, architectural blueprints, and industrial design models.
How we enforce your rights.
The Cease & Desist
We issue a formal, legally binding demand letter. The infringer is ordered to immediately cease the unauthorized use, remove the infringing material from all platforms, and sign a "Cease and Desist Declaration" containing a severe penalty clause for future violations.
Claiming Damages
Stopping the infringement is not enough. Under Dutch law, you are entitled to damages for lost revenue, reputational harm, and the diminishment of exclusivity. We calculate and demand full financial compensation, including the profits made by the infringer.
Court Injunction
If the infringer ignores the demand or refuses to pay, we initiate summary proceedings (Kort Geding). We request an immediate court order forcing them to stop, backed by daily penalty payments (dwangsommen), and the seizure of infringing goods.

Frequently asked questions
Do I need to register my copyright in the Netherlands?
Can I recover my legal fees from the infringer?
Yes. Unlike regular civil procedures where only a small, fixed amount is awarded, Intellectual Property cases fall under Article 1019 of the Dutch Code of Civil Procedure. This means the losing party can be ordered to pay the full, actual legal costs incurred by the winning party.
What is an Ex Parte injunction?
