Civil litigation in the Netherlands relies heavily on written documentation before oral arguments occur. This is how the typical Kantonrechter procedure unfolds.
Writ of Summons (Dagvaarding)
The proceeding begins with a formal writ delivered by a bailiff (deurwaarder). It details the claim, provides the legal basis, and orders the defendant to appear before the court.
Statement of Defense (Verweer)
The defendant submits a written defense (conclusie van antwoord) refuting the claims. This document must be supported by evidence, and the defendant can potentially file a counterclaim at this stage.
Oral Hearing (Zitting)
The judge convenes a hearing (comparitie) to ask questions, allow lawyers to plead their case, and explore the possibility of a settlement between parties.
The Verdict (Vonnis)
The judge issues a binding written judgment. If favorable, the verdict provides an enforceable title to collect debts via a bailiff, enforce contracts, or execute an eviction.
